Rules of good faith
The parties shall always act according to the rules of good faith. No right may be exercised with the intent of injuring another or in an excessive and unreasonable manner which is contrary to the requirements of good faith.

Deposit
Tenant has to pay a deposit to be refunded to him at the end of the contract period. Tenant shall settle down with the land lord all bills due for telephone, Private parking fees, Electricity, House keeping and the repair value of all damage if any in the apartment before he or she reclaim deposit.

Sublet to a third party
It is prohibited for the tenant to sublet to a Third party all or part of the leased apartment. Without prejudice to, if applicable, the tenant right to use the apartment as a paid residence for his foreign experts and clients, in condition that the tenant will provide the landlord with a photo copy of a valid identification document of that person  before he or she moves in to the apartment.

Moving in to the apartment
Tenant hereby declares he has taken over the leased apartment furnished and free of any damage or defect. He is responsible for the apartments. He undertakes to safe keep it and delivers same intact, at the end of the lease period. Tenant shall not be authorized to make any changes, paint premises front, remove walls, open windows, install air conditioning units or make any other alterations. Tenant undertakes to deliver the leased apartment in good condition at the end of the leased period. The tenant may not, without the consent of the landlord, use or keep in the dwelling a substance which constitutes a risk of fire or explosion.

Enjoyment of premises
The tenant shall throughout the term of the lease, use the leased property with prudence and diligence, he must use it in a reasonable fashion. The tenant and the persons he allows to use or to have access to his dwelling shall act in such a way as not to disturb the normal enjoyment of the other tenants.

House keeping
Due to the administration highly concern about the safety of the premises, Floors and furniture in the apartments, it is strongly recommended that tenants who are in need for a house keeping  shall ask the administration for this service. Professionals House keeping service is provided once or twice a week with a separate agreement. Our trained team have many years of experience and are trained to look after the materials used in the apartments, to use the appropriate tools for cleaning without damaging the place and   to report for any defections or miss functions of equipments.The administration can take an immediate action to repair the defected piece. House keeping hired from out side Sergio suites might not be aware of many issues that the administration find them important to safe keep our promises.

Maintenance of dwelling and repairs
The landlord is obligated to warrant the tenant that the dwelling may be used for the purpose for which it was leased and to maintain the dwelling for that purpose. A tenant who becomes aware of a serious defect or deterioration of the dwelling shall inform the landlord immediately. The tenant shall allow urgent and necessary repairs to be made to ensure the preservation and enjoyment of the leased property.

Access to and visit of dwelling
No lock or other device restricting access to an apartment may be installed or changed without the consent of the landlord, if an emergency occurs and access to the apartment is not accessible, the tenant will be responsible for any damages. To exercise rights of access to the apartment the landlord and the tenant are bound to act in good faith: The tenant shall facilitate access to the apartment and shall not refuse access without justification; The landlord shall not abuse his rights and shall exercise them in a reasonable manner with due to respect for privacy. The land lord may, during the lease, have access to the apartment:

  • To ascertain the condition of the dwelling between 9:00 am and 9:00 pm;
  • To carry out work between 7:00 am and 7:00 pm.

In both cases, the landlord shall give the lessee 24 hours’ notice in writing or orally. In case of an emergency or an immediate action that should be taken, land lord or maintenance personnel don’t need a permission to enter the apartment to save the place.

Parking in the garage
We are happy to provide you with a spot in the garage to park your car; this spot is private and shall be used only by you. Only your car is allowed to park in this spot. Parking fees are paid with the rent and according to the rent payment schedule.

Renewal and modification of lease
A lease with a fixed term is automatically renewed. However, a lease with a term longer than 12 months is renewed for 1 year only. The landlord has the right not to renew the lease and shall give notice to the tenant two months in advance by a registered letter. At the renewal of the lease, the landlord may modify its conditions. For instance, he may modify its term or increase the rent.

Leaving during the rental period
If tenant wishes to leave the leased apartment during the rental period, tenant should give notice to that effect to the landlord two months in advance by a registered letter. Tenant will loose his right to claim his deposit refund if he leaves the apartment before end of contract date.

Non-payment of rent
Entitles the landlord to obtain from the court a condemnation forcing the lessee to pay it. Also, if the lessee is over 4 weeks late in paying his rent, the landlord may obtain the cancellation of the lease. Frequent late payment of the rent may also warrant the cancellation of the lease.

Correspondences
All correspondences addressed to either party on the addresses set forth herein shall be deemed valid and legally binding on the parties herein.
